1. Service Provider and Scope
Archive My Legacy ("AML", "we", "us" or the "Service") is operated by:

Archive My Legacy is currently operated by an individual, not by an incorporated company.
The Service is a digital platform designed to help users collect family photographs and memories, collaborate with invited participants, generate AI-assisted family stories, edit those stories and download illustrated books in PDF format.
AML is currently a free service under development. Its features, availability and conditions of access may evolve.
These Terms govern access to and use of the Service. They should be read together with our Privacy Policy.
2. Eligibility and Registration
The Service is intended for individuals aged 18 or older.
Users must provide the information reasonably required for registration and account management and keep their account information accurate.
Users are responsible for maintaining the confidentiality of their authentication credentials and for activities carried out through their accounts, except where responsibility lies with AML or another party under applicable law.
Accounts are personal and must not be transferred or used to impersonate another person without authorisation.
AML may restrict registrations, limit access or refuse participation for legitimate operational, security or legal reasons, subject to applicable law.
3. Family Projects and Collaboration
The Service allows users to create family projects and invite other people to contribute.
Depending on the available functionality and permissions, participants may be able to view photographs, add comments, contribute information, edit content or participate in creating family stories.
Users are responsible for choosing whom they invite and for considering the privacy and rights of the individuals concerned.
Participants should understand that information contributed to a shared project may be accessible to other authorised participants and may be incorporated into stories or books generated from that project.
Other participants may download and retain copies of books or information made available to them through the Service.
AML does not control copies that users or collaborators have lawfully downloaded, saved or shared outside the Service.
Access permissions and collaboration features may be modified as the Service evolves.
4. User Content and Intellectual Property
4.1. Original Content
Users retain the rights they hold in photographs, documents, comments and other materials they submit to the Service ("User Content").
Users are responsible for ensuring that they have the rights and authorisations legally necessary to upload, process and share their contributions.
Uploading content does not transfer ownership of that content to AML.
4.2. Licence to Operate the Service
By submitting User Content, users grant AML a non-exclusive, royalty-free licence to host, reproduce, process, transform and display that content to the extent necessary to provide, maintain and operate the Service and its requested features.
This includes processing by technical providers and AI services acting in connection with the operation of AML.
For shared projects, users also authorise the use of their contributions within the collaboration features available to the participants they have permitted to access the project.
The licence is limited to these purposes and any further retention or processing permitted or required by applicable law.
AML does not acquire ownership of User Content through this licence.
4.3. AI-Generated Narratives and Books
The Service generates narratives and layouts using artificial intelligence and other software components.
AML does not claim exclusive ownership of the family stories or books generated for users.
Users may download, print and share their generated books, subject to applicable law and the intellectual property, privacy and other rights of contributors and third parties.
AML does not guarantee that AI-generated material is original, copyright-protected, exclusive or free from similarities to other material.
These Terms do not transfer rights belonging to third parties or grant rights that AML does not possess.
5. Acceptable Use and Third-Party Rights
Users must use the Service lawfully and respect the rights of others.
In particular, users must not intentionally:
• Upload or share content that infringes intellectual property rights, privacy rights or other rights protected by law.
• Submit defamatory, threatening, harassing or otherwise unlawful material.
• Impersonate another person or provide deliberately misleading information in order to cause harm.
• Upload unlawful content or unnecessarily disclose sensitive personal information about living individuals, particularly information concerning health, religious beliefs, political opinions or other special categories protected under Article 9 of the GDPR.
• Attempt to gain unauthorised access to accounts, projects, data or technical systems.
• Interfere with the security, integrity or functioning of the Service.
• Use the Service for unlawful surveillance, harassment or other activities incompatible with its family-storytelling purpose.
The presence of an individual in a photograph does not, by itself, mean that the user's processing of that photograph necessarily requires that individual's consent. Users remain responsible for complying with the legal requirements applicable to their particular use.
AML may review reports of potentially unlawful content and may remove or restrict access to content, suspend accounts or take other proportionate measures where justified by legal, security or operational reasons.
Potentially unlawful content or misuse may be reported to info@archivemylegacy.com.
AML will provide information about restrictions and decisions where required by applicable law.
6. Artificial Intelligence, Editing and PDF Generation
AML uses artificial intelligence, including third-party AI services such as Google's Gemini API, to assist in generating family stories from photographs, memories, comments and contextual information.
AI-generated content may contain inaccuracies, omissions, invented details or interpretations that are not supported by the information provided.
AI-generated narratives are suggestions for users to review, not verified historical records.
Users can review and modify generated stories using the editor provided by the Service before downloading their books in PDF format.
Users are responsible for checking the accuracy and suitability of the content they choose to retain or share, particularly where it concerns identifiable living individuals.
AML does not guarantee:
• The historical or factual accuracy of generated narratives.
• The absence of errors or omissions in AI-generated material.
• That a particular photograph or collection of memories will produce a satisfactory story.
• That the editor or PDF-generation functionality will operate without interruption or error.
• Compatibility with every device, browser, PDF reader or printing system.
Downloaded PDF files may be retained, modified or shared outside AML's control.
Users are responsible for preserving their own copies of important original materials and downloaded books.
7. Privacy and Personal Data
The processing of personal data through AML is described in the Privacy Policy.
Users should consider the privacy of family members and other people mentioned or depicted in their projects.
User Content may contain personal data relating to individuals who do not have AML accounts. AML processes such information in accordance with applicable data protection law, including where a separate legal basis or additional safeguards are required.
The rights of individuals whose personal information appears in the Service are not waived by these Terms.
Users may contact info@archivemylegacy.com regarding privacy concerns or requests relating to personal data.
8. Free Access and Experimental Nature
The Service is currently provided free of charge as part of an ongoing development and evaluation programme.
AML may establish reasonable usage limits, including limits relating to projects, photographs, collaborators, processing resources or generated content.
Features may be added, changed, restricted or withdrawn as the Service develops.
AML does not undertake to maintain any particular feature, usage limit, technical configuration or free-access model indefinitely.
If paid services are introduced, any applicable charges and contractual conditions will be communicated before users incur a payment obligation.
No service-level agreement, minimum availability or specific response time is provided unless expressly agreed otherwise.
Mandatory rights granted by applicable consumer law remain unaffected.
9. Storage, Availability and Downloads
AML stores information needed to operate accounts and family projects, subject to its Privacy Policy and applicable law.
The Service is not guaranteed to be continuously available or free from technical incidents.
AML does not guarantee that uploaded materials, generated narratives, editable stories or downloadable books will remain accessible indefinitely.
Data may be affected by technical failures, accidental deletion, security incidents, changes to the Service or other events.
Users should retain their original photographs and documents and download copies of books they wish to keep.
AML may change its technical infrastructure, hosting providers, storage arrangements and methods of generating or delivering content, subject to applicable data protection and consumer law.
Nothing in these Terms limits any mandatory legal rights to access, portability or retrieval of information or content.
10. Suspension, Account Closure and Discontinuation
Users may request account closure by contacting info@archivemylegacy.com.
Personal data will be handled in accordance with the Privacy Policy and applicable data protection law.
AML may suspend, restrict, modify or discontinue some or all of the Service for legitimate reasons, including:
• Technical, operational or security requirements.
• Suspected misuse or unlawful activity.
• Changes in third-party services or available resources.
• Changes in legal or regulatory requirements.
• Decisions concerning the continued development or operation of the project.
AML may terminate an account where justified by a serious breach of these Terms or another legitimate reason recognised by applicable law.
Where practicable, users may be informed in advance of significant planned changes or discontinuation. No fixed contractual notice period is guaranteed beyond what applicable law requires.
Account closure or discontinuation may result in loss of access to content remaining within the Service.
AML cannot retrieve or delete copies of books or other information that have already been downloaded and retained independently by other users.
Mandatory legal requirements concerning termination, personal data and content retrieval remain applicable.
11. Responsibility, Disclaimers and Liability
AML is provided as a free service under development.
Although reasonable efforts are made to operate and secure the Service, AML does not guarantee uninterrupted availability, error-free functionality, accurate AI-generated output or the preservation of all submitted material.
To the extent permitted by applicable law, AML is not responsible for losses arising from:
• Inaccuracies or omissions in AI-generated narratives that users have had the opportunity to review.
• Unlawful, inaccurate or unauthorised content submitted by users.
• Actions taken independently by invited collaborators.
• Losses caused by a user's failure to retain original materials or downloaded files.
• Interruptions, incompatibilities or failures attributable to third-party systems or circumstances outside AML's reasonable control.
These provisions apply only to the extent permitted by law and do not exclude or restrict liability for fraud, wilful misconduct, or any other liability that cannot lawfully be excluded or restricted.
Nothing in these Terms limits mandatory rights or remedies available under applicable consumer protection law.
Indemnification for User Content
To the extent permitted by applicable law, you agree to indemnify and hold harmless Bertrand Jager, operating as Archive My Legacy, against reasonable losses, damages, liabilities, costs and legal expenses arising from third-party claims, to the extent caused by:
• User Content that you unlawfully upload, submit or share through the Service;
• Your infringement of third-party intellectual property, privacy or other legally protected rights;
• Your material breach of these Terms.
This indemnification obligation does not extend to losses attributable to AML's own unlawful conduct or to liabilities that cannot legally be transferred to users.
12. Changes to the Terms and Transfer of the Service
AML may update these Terms to reflect changes to the Service, its organisation, legal requirements or operating conditions.
Updated Terms will be made available with their effective date. Where required by law, users will receive additional notice or be asked to accept the changes.
The operation of AML may in the future be transferred to a company or another successor operator.
Such a transfer may involve transferring contractual relationships and information necessary to continue the Service, subject to applicable law, the rights of users and the data protection requirements in force at the time.
Where legally required, users will be informed of the new operator and of any resulting changes.
Nothing in this section authorises a transfer or processing of personal data without an appropriate legal basis.
13. Applicable Law and Contact
These Terms are governed by Luxembourg law, without prejudice to mandatory consumer protection rules applicable in a user's country of habitual residence.
Disputes will be submitted to the courts competent under applicable law. Nothing in these Terms deprives consumers of mandatory rights concerning jurisdiction or remedies.
Users are encouraged to contact AML first in order to seek an amicable resolution.
